Vacation Points Usage Contract

Mickey and Minnie Mouse (DVC member) certify they have and will maintain, in good standing, an ownership interest in the Disney Vacation Club, throughout this contract period, sufficient to carry out the terms of this contract. DVC member desires to make this reservation in the tenant's name and benefit in exchange for payment.

Donald Duck (tenant) certifies desire to purchase (rent) this reservation and has the ability to make full payment.

This contract is entered into, in good faith, between DVC member and tenant for the express purpose of renting reserved lodging as set forth below.

 

Names in Tenant's Party:

Donald and Daisy Duck plus two adults and two children for a total of six people.

Unit Description and Location:

2 Bedroom Standard View at Boardwalk Villas, Walt Disney World, Florida.

Room request made to DVC Member Services:

non-smoking

Duration and Dates: 7 nights

Thursday, January 23, through Wednesday, January 29, 2003 with check-out on Thursday January 30.

Calculations:

222 points at $10 /point, for a total of $2,220.

Payments / Deposits:

10% due by September 30, 2002

Full Balance ($1998) is due by December 18, 2002 if payment is made by electronic transfer via PayPal.com, money order, or cashier's check. DVC member cannot accept credit card payment via PayPal.com.

If payment is made by personal check, check must be received by December 4, 2002.

Cancellation and Refunds:

In the event of a cancellation up to and through December 19, 2002, either at the request of tenant or default on payments, tenant will be eligible for a full refund, less $5.00 handling fee. Refund will be mailed within 15 days of cancellation.

In the event tenant requests a cancellation after December 19th, 2002, the DVC member may retain the full amount received, as points may not be recoverable.

Tenant may request, and DVC member may consider, to reschedule the reservation. Tenant should be aware that this may not be possible because of limited room availability. If DVC member is able to resell all or a portion of the unused reservation, and/or recover use of associated points, the Tenant will receive an additional refund.

Force Majeure:

In the case of a catastrophic event beyond the control of the Disney Vacation Club to fulfill the essentials of this contract, to provide the specified lodging during the specified times, both parties agree to equally share the loss of non-recoverable points.

Tenant agrees to follow the DVC rules and accepts responsibility and liability for the use of DVC property, including no pets. Tenant agrees to indemnify and hold harmless DVC member due to any actions taken by tenant, tenant's named party and/or tenant's guests during the execution of this reservation. ________(Tenant’s initials)
